Terms of Service
These terms govern your use of the Avalon Systems platform, the Avalon Densitometer, the Avalon CR-100 viewer, the Avalon mobile applications, and this website (together, the "Services"). By using the Services, you agree to these terms.
The Services
Avalon Systems provides field-operations software, instrumentation, and imaging tools for nondestructive testing organizations. Each customer's use of the Services is governed by these terms together with any specific order, statement of work, or master agreement signed by both parties.
Accounts
You're responsible for the activity that happens under your account. Keep your credentials confidential. Use a passkey or a strong password. Tell us promptly at security@avalon-sys.com if you believe an account has been compromised.
Acceptable Use
Don't use the Services to break the law, infringe intellectual-property rights, harm minors, or disrupt the Services for other customers. Don't try to reverse-engineer the platform, attempt to access another customer's data, or use the Services to send unsolicited messages.
Customer Data
Your data is yours. We don't sell it, mine it, or use it to train external models. Where the customer hosts Avalon themselves, we never see the data at all. Where Avalon hosts on the customer's behalf, the data is held under the privacy policy and exported on request.
Hardware Warranty
The Avalon Densitometer carries a one-year limited warranty for parts and labor under normal use. The warranty does not cover misuse, unauthorized modification, or damage in transit after delivery. Specifications are subject to change without notice as we improve the product.
Software License
For each Avalon software product, Avalon grants the customer a non-exclusive, non-transferable license to use the software for the customer's internal business purposes, for the duration of the customer's active subscription. The license does not grant the customer any rights in the underlying source code or in any third-party libraries used by the software.
Third-Party Components
Avalon uses open-source components — including Cornerstone, dicom-parser, Express, React, and PostgreSQL — under their respective licenses. Avalon's use of these components does not transfer any of their licenses to the customer.
Mobile Applications
The Avalon Systems iOS and iPadOS apps are distributed through the Apple App Store. Use of those apps is also governed by the Apple Media Services terms.
Disclaimer
The Services are provided "as is." We work hard to keep them reliable, but we make no warranty that they will be uninterrupted, error-free, or fit for any particular regulatory or contractual requirement. NDT-specific code compliance (ISO 17636-2, ASME Section V, etc.) is the responsibility of the using organization and the qualified inspector signing the report.
Limitation of Liability
To the maximum extent allowed by law, Avalon Systems will not be liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, revenues, or business arising out of the use of the Services. Our total liability for any claim arising from the Services will not exceed the fees paid by the customer in the twelve months before the claim.
Termination
Either party may terminate the agreement on written notice. On termination, the customer's right to use the Services ends, and Avalon will return or delete customer data per the privacy policy and any signed master agreement.
Governing Law
These terms are governed by the laws of the State of Indiana, USA, without regard to conflict-of-laws principles. The exclusive venue for any dispute is the state and federal courts located in Marion County, Indiana.
Changes
We may update these terms from time to time. The new version posts here with an updated date. Continued use of the Services after the change is acceptance of the updated terms.
